Terms of Service
1. Agreement
By downloading, installing, or using Proximity ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. License
Light is Beauty Inc. grants you a personal, non-exclusive, non-transferable license to install and use the App on macOS devices that you own or control. Your license covers use on up to two (2) machines registered to you. You may not sublicense, resell, rent, lease, or distribute the App or any portion of it.
3. Purchase and Payment
The App is sold as a one-time purchase at the listed price at the time of purchase. Payments are processed by Paddle.com Market Limited ("Paddle"), which acts as Merchant of Record. All billing inquiries, refund requests, and payment disputes should be directed to Paddle. Your purchase is subject to Paddle's terms in addition to these Terms.
4. Refund Policy
Refunds are available within 14 days of purchase, provided the App has not been activated on more than one device. To request a refund, contact us at proximity@lightisbeauty.com or contact Paddle directly. Refunds are issued at our discretion after that period.
5. Updates
Updates released during the version 1.x lifecycle are included with your purchase at no additional charge. Major version releases (e.g., version 2.0) may be offered as a separate purchase or upgrade.
6. Intellectual Property
The App, including all code, design, graphics, and documentation, is the exclusive property of Light is Beauty Inc. and is protected by United States and international copyright law. Nothing in these Terms grants you ownership of any intellectual property.
7. Prohibited Use
- Reverse engineer, decompile, or disassemble the App
- Modify or create derivative works based on the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices in the App
8. Disclaimer of Warranties
The App is provided "as is" without warranty of any kind, express or implied. Light is Beauty Inc. does not warrant that the App will be error-free, uninterrupted, or compatible with any specific hardware or third-party software. Use of the App in professional or commercial settings is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Light is Beauty Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the App.
10. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Florida.
11. Changes to These Terms
We may update these Terms at any time. The current version will be posted at proximity.lightisbeauty.com/terms. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
